| Lame duck challenge ends with free codeweavers software for all gzipped_tar writes to tell us that The Codeweavers "Great American Lame Duck Presidential Challenge" has ended in surprise and free software all day Tuesday (October 28, 2008) at the Codeweavers site. A while back Codeweavers gave President Bush a challenge to meet one of several goals before he left office. One of these goals was to lower gas prices in the Twin Cities below $2.79 a gallon, which has since transpired. "How was I to know that President Bush would take my challenge so seriously? And, give the man credit, I didn't think there was *any* way he could pull it off. But engineering a total market meltdown - wow - that was pure genius. I clearly underestimated the man. I'm ashamed that I goaded him into this and take full responsibility for the collapse of any savings you might have. They did at least get rid of provisions that would have had the DOJ take over the RIAA's unpopular litigation campaign. Still, the final legislation (PDF) creates new classes of felony criminal copyright infringement, adds civil forfeiture provisions that incorporate by reference parts of the Comprehensive Drug Abuse Prevention and Control Act of 1970, and directs the Copyright Czar to lobby foreign governments to adopt stronger IP laws. | Commerce department pushing for new "copyright czar" TechDirt is reporting that those all-too-familiar "stats" surrounding the cost of piracy are being trotted out in an attempt to push through a new "Copyright Czar" position. "In urging President Bush to sign into law the ProIP bill, which would give him a copyright czar (something the Justice Department had said it doesn't want), the US Chamber of Commerce is claiming that 750,000 American jobs have been lost to piracy. | Skype messages monitored in china Pickens writes "Human-rights activists have discovered a huge surveillance system in China that monitors and archives Internet text conversations sent by customers of Tom-Skype, a joint venture between a Chinese wireless operator and eBay. Researchers say the system monitors a list of politically charged words that includes words related to the religious group Falun Gong, Taiwan independence, the Chinese Communist Party and also words like democracy, earthquake and milk powder. The encrypted list of words inside the Tom-Skype software blocks the transmission of these words and records personal information about the customers who send the messages. Researchers say their discovery contradicts a public statement made by Skype executives in 2006 that 'full end-to-end security is preserved and there is no compromise of people's privacy.' The Chinese government is not alone in its Internet surveillance efforts. In 2005, The New York Times reported that the National Security Agency was monitoring large volumes of telephone and Internet communications flowing into and out of the United States as part of an eavesdropping program that President Bush approved after the Sept. 11 attacks. 'This is the worst nightmares of the conspiracy theorists around surveillance coming true,' says Ronald J. Deibert, an associate professor of political science at the University of Toronto. While they stripped out the provision to have the DoJ act as copyright cops, it still contains increased penalties for infringement, civil forfeiture provisions, and creates an 'IP czar' to coordinate enforcement. Even though the civil forfeiture provisions are ostensibly intended for use against commercial piracy outfits, history indicates that they will probably get used against individuals at some point. Worse, because they left out the only part of the bill that Bush threatened to veto, it is expected to pass. The companies said the US courts and Congress are still working out the correct balance between protecting copyrights and the free exchange of information on the Web and a treaty could be counterproductive. 'There's this assumption that what is good for Disney is what's good for America, but that's an oversimplification,' said Jonathan Band, an intellectual property lawyer representing libraries and high-tech companies.
